Terms of service

Effective September 10, 2026

These terms govern your use of SetMore AI. By creating an account, you agree to them.

Definitions

  • "SetMore AI", "we", "us" means the operator of SetMore AI.
  • "Customer", "you" means the business or individual that creates an account.
  • "Workspace" means the account and configuration that belongs to one Customer, including any sub-accounts an agency Customer creates for its clients.
  • "Lead" means a person your Workspace communicates with through the service.
  • "Service" means SetMore AI: the AI assistant, the portal, and the underlying infrastructure that sends and receives messages on your behalf.

Account and workspace

You are responsible for the accuracy of your account information and for activity under your account, including anyone you invite to your Workspace. Agency Customers own and are responsible for every sub-account and every Lead their sub-accounts message.

The service

SetMore AI provides an AI assistant that replies to Leads over text on your behalf: qualifying them in conversation, booking appointments onto your connected calendar, and following up. You are the sender of record for every message the assistant sends, as between you and us. This allocation of responsibility does not determine statutory liability or remove obligations that applicable law places on us. You are solely responsible for having lawful consent to message every Lead your Workspace contacts, for the accuracy of what the assistant is told to represent about your business, and for reviewing the appointments it books.

Plans and billing

Current plans, included usage, and pricing are shown on our pricing page and in your account; we may change them from time to time, effective for your next billing period. The following billing terms apply regardless of plan, except where noted:

  • Every plan is charged on the day you subscribe, unless a promotional code you apply at checkout discounts your first payments; that discount ends on the date shown at checkout, and the regular price is charged from then on. There is no trial period and no setup fee. A valid payment method is required at checkout. On every plan except Starter, the monthly price includes a real phone line, and that line is provisioned for your Workspace once payment goes through. Starter includes no line from us: it runs on the messaging number you already have with your own provider.
  • Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, until you cancel.
  • Agency plans that include sub-accounts bill each sub-account's line as a separate recurring line item, in addition to the base plan price.
  • Cancellation takes effect at the end of your current billing period; you keep access until then. We do not provide refunds or credits for partial billing periods.

Messaging rules

The Service exists to carry conversations you already have a right to have. Every message it sends on your behalf, whether from the assistant or from a person on your team, follows these rules:

  • Lawful basis. Every person you message must fall into one of three groups: they gave prior express written consent to be texted, they have an established business relationship with you (a purchase within the last 18 months, an inquiry or application within the last 3 months, or another affirmative interaction with your business), or they texted your Workspace first. These categories describe eligibility to use the Service, not a legal exemption. A business relationship, possession of a number, or an inbound inquiry does not replace any consent required for the particular message. Obtain prior express written consent where required, and keep replies within the scope of the recipient's request or permission.
  • No purchased or scraped numbers. Numbers that were purchased, rented, scraped, or pulled from a directory or listing service, including Google Maps, may never be messaged through the Service. There is no B2B exception.
  • Sender identity. The first message to anyone says which business it is from.
  • One message, then silence. A person who has not written back gets exactly one plain-text message and nothing else: no follow-up, photo, link, or voice note, until they reply. This is a customer obligation on every channel. Automated campaign controls enforce it on supported paths; manual CRM tools may not apply the same checks. You must follow the rule even when a tool permits a send.
  • Opt-out. STOP, or any reasonable indication that someone wants messages to end, is honored immediately across every line in that Workspace. No exact keyword is required, and nobody is re-added without fresh consent. An opt-out is recorded per Workspace, so if you operate more than one Workspace it is your obligation, not ours, to stop messaging that person from the others. You may not contact that person through another channel to work around an opt-out.
  • Quiet hours. You must limit messages your Workspace starts to 8 AM to 8 PM in the recipient's local time, or a narrower legally required window. Automated proactive sends use scheduling controls on supported paths. Manual CRM sends may not apply those checks, so you must verify the time before sending.
  • AI disclosure. The assistant identifies itself as automated whenever it is asked. You may not instruct it to claim otherwise.
  • Prohibited content. Sexual content, hate speech, and content promoting alcohol, firearms, or tobacco, along with fraud, harassment, impersonation, and anything else unlawful, are never permitted through the Service.
  • Consent records. You keep proof of consent for every person you message for at least 4 years and produce it to us within 5 business days of a request. We may audit your lists at any time and suspend your account if you refuse.
  • Applicable requirements. You must comply with applicable federal and state messaging, privacy, and telemarketing laws, do-not-call restrictions, and the rules of the networks carrying your messages. Follow any stricter consent, registration, disclosure, or sending-time requirements that apply to your use case. Check that the recipient still controls the number before relying on old consent.

Messaging classification. A phone number, one-to-one conversation, iMessage delivery, or a P2P label does not establish that your use is exempt from law or network rules. Automation and message purpose matter. We do not certify your legal classification or provide legal advice. Our controls and your attestations do not independently verify consent or guarantee compliance.

You must not use additional numbers, accounts, or channels to evade opt-outs, restrictions, or suspensions. The Messaging policy forms part of these Terms. A violation may result in immediate suspension.

Outbound mode

Outbound mode, where your Workspace starts the first message to a list of leads, is a separate, paid enrollment.

  • Every list requires an opt-in attestation, and every campaign start requires a confirmation. Both are binding representations to us, recorded with the name and time of the person who made them.
  • Daily new-contact ceilings, sending pace, and the hours a message can go out are set by the Service and cannot be raised, on any plan.
  • If a line is withdrawn, restricted, or banned by Apple or a carrier as a result of your Workspace's messaging, that loss is yours: no refund, and a replacement line is provisioned at your cost.
  • You reimburse us for any fee, penalty, or loss our messaging infrastructure provider imposes on us because of your Workspace's messaging, including the loss of other lines.
  • We may pause outbound messaging for any Workspace at any time to protect the number pool for every customer.

Phone numbers

Phone numbers are provisioned for your Workspace's use for as long as your account is active and in good standing; you do not own the number outright. Numbers can be withdrawn by the carrier or messaging network at any time and without notice, including as a result of a ban triggered by messaging behavior on your account. A ban is not guaranteed to be reversible. We do not guarantee number retention, portability, delivery, or uninterrupted access to a particular messaging network. Refund restrictions apply only to the extent permitted by law.

AI limitations

The assistant is an AI system and can make mistakes: it can misread a Lead's intent, book the wrong time, or say something you would not have said. You are responsible for reviewing bookings the assistant makes. We do not guarantee any particular outcome, response rate, conversion rate, or amount of revenue from using the service.

Data ownership

You own the data your Leads generate through your Workspace: their contact information and the conversations the assistant has on your behalf. You grant us a license to store, process, and use that data solely to operate the service for you, as described in our Privacy policy.

Suspension and termination

We may suspend or terminate your access if you violate these terms, your payment fails and is not cured, or your use puts our messaging infrastructure or other customers at risk (for example, triggering carrier-level restrictions). We will give notice where practical. You may cancel at any time from your account settings.

Warranties

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the fees you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, or consequential damages, including lost revenue or lost business.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless against third-party claims arising from your breach of these Terms, unlawful messaging, missing consent, or content and instructions you provide, including activity by your team and client accounts. This does not require you to indemnify us for our own fraud, willful misconduct, or liability that cannot lawfully be transferred.

This includes claims and penalties under the TCPA and state telemarketing or consent laws, claims brought by people you messaged, charges or losses imposed on us by our messaging or carrier providers because of your Workspace's use of the Service, regulatory inquiries, and the reasonable attorney's fees of defending any of these. Our messaging infrastructure provider is an intended third-party beneficiary of the Messaging rules and Outbound mode sections above and may enforce them directly.

Mandatory rights

These Terms do not exclude rights, remedies, warranties, or liability that applicable law does not allow the parties to exclude. No clause prevents a recipient or regulator from enforcing applicable law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Changes

We may update these terms from time to time. If we make a material change, we will update the effective date above and notify account owners by email.
